Technical Short: Scottish Personal Insolvency Technical Update

In this webinar we will look at recent statutory changes to the Bankruptcy (Scotland) Act 2016 and anticipated changes to the protected trust deed process set out in the draft Protected Trust Deeds (Miscellaneous Amendment) (Scotland) Regulations 2024. We will look at the corresponding changes to SIP 3.3 and consider the impact of both on the AiB’s PTD Protocol.

Description

In late 2019, Scottish Ministers commenced a wide-ranging policy review of Scotland’s statutory debt solutions, with the aim of enhancing and improving the system of debt relief. Commenced pre-pandemic and acquiring an added significance at a time of cost of living crisis, the review consists of three stages.   As a result of Stage 1 and Stage 2, a number of changes have been and will be introduced to the sequestration and protected trust deed process.
